Terms of Service

1. Acceptance of Terms

By accessing or using Disclosed Capitol ("the Service"), operated by Disclosed Capitol LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We may update these Terms at any time, and your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

Disclosed Capitol provides publicly available data about US congressional stock trades, lobbying filings, campaign contributions, legislation, and government contracts. We aggregate, organize, enrich, and present this data for informational and research purposes. The Service includes a website, API, and AI-powered research assistant (Chad AI).

4. User Accounts

Some features require a registered account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information when creating an account and promptly update it if it changes. You must not share your account credentials with others or allow multiple users to access a single account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans & Billing

Paid plans (Pro) are billed on a recurring monthly basis via Stripe. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. We reserve the right to change pricing with 30 days' notice to active subscribers. Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. If payment fails, we may suspend access until payment is resolved.

6. API Credits & Usage

API access uses a credit-based system. Credits are consumed per API call, with costs varying by endpoint (1-10 credits per call). Pro subscribers receive 30,000 credits per month included with their subscription. Additional credits may be purchased separately. Purchased credits are valid for 1 year from the date of purchase.

Unused monthly credits from Pro subscriptions do not roll over. Refunds are not provided for unused credits. We reserve the right to adjust credit costs and rate limits to ensure service stability.

7. Rate Limits

API and website access is subject to rate limits based on your account tier. Public (unauthenticated) access is limited to 200 requests per day per IP address. Authenticated API rate limits scale with your trailing 30-day credit spend: Basic (60 req/min, $5+), Plus (240 req/min, $25+), Power (600 req/min, $100+). Exceeding your rate limit will result in temporary throttling (HTTP 429 responses). Persistent abuse may result in account suspension.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, crawl, or otherwise extract data in bulk without API authorization
  • Use automated tools (bots, scrapers, scripts) to access the website without our written consent
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
  • Resell, redistribute, or sublicense the dataset in bulk as a standalone data feed (building your own product, application, or research on top of API data is permitted — see Section 9)
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent rate limits, authentication, or access controls
  • Use the Service to build a competing data API, feed, or database product
  • Impersonate another person or misrepresent your affiliation with any entity
  • Upload or transmit malicious code, viruses, or harmful content
  • Engage in any activity that places unreasonable load on our infrastructure

We reserve the right to investigate violations and take appropriate action, including suspension or termination of access, reporting to law enforcement, and pursuing legal remedies.

9. Intellectual Property

The Service, including its design, code, branding, logos, and original content, is owned by Disclosed Capitol LLC and protected by applicable intellectual property laws. The underlying government data is public domain, but our aggregation, analysis, enrichment, presentation, and derived datasets are proprietary.

Except as granted below, you may not reproduce, distribute, modify, create derivative works from, or publicly display content from the Service without our written permission.

9.1 Commercial Use of API Data

Data you retrieve through the Disclosed Capitol API using an active API key, whether on a free or paid plan, may be used commercially. This includes building and selling applications, AI agents, dashboards, trading tools, newsletters, research, and client deliverables that incorporate the data. There is no non-commercial restriction on self-serve plans, and no separate license or written permission is required.

This grant does not extend to:

  • Reselling or redistributing the dataset in bulk as a standalone data feed, API, or database product substantially similar to the Service
  • Scraping the website or bypassing the API to obtain data outside your plan's credits and rate limits
  • Any use of the Service's design, code, page layouts, or original written content, which remain proprietary

9.2 Branding & Trademarks

"Disclosed Capitol," "Chad AI," our logos, and our other names and marks remain the exclusive property of Disclosed Capitol LLC. Nothing in these Terms grants you a license to use them. You may factually state that your product is powered by or sourced from Disclosed Capitol, but you may not use our marks in your product name, logo, or domain, and you may not imply endorsement, affiliation, or partnership without our written permission. Attribution is appreciated but not required for commercial use of API data under Section 9.1.

10. AI Features (Chad AI)

Chad AI is an AI-powered research assistant. By using Chad AI, you acknowledge that:

  • Responses are generated by AI and may contain errors, inaccuracies, or outdated information
  • Chad AI does not provide investment, financial, legal, or professional advice
  • Your conversations may be stored and used to improve the service
  • Conversations are processed by third-party AI providers (xAI)
  • You should independently verify any information provided by Chad AI

11. Not Investment Advice

The Service provides publicly available data for informational and research purposes only. Nothing on this website or through the API constitutes investment advice, financial advice, trading advice, or any other sort of advice. You should not make any investment decisions based solely on information from this Service. See our Disclaimer for full details.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the data is complete, accurate, current, or error-free, or that the Service will be uninterrupted or secure.

13. Limitation of Liability

To the maximum extent permitted by law, Disclosed Capitol LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to investment losses, lost profits, data loss, or business interruption. Our total liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

14. Indemnification

You agree to indemnify, defend, and hold harmless Disclosed Capitol LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Third-Party Links

The Service may contain links to third-party websites. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party sites. Inclusion of a link does not imply endorsement.

16. Termination

We may suspend or terminate your access to the Service at our discretion, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, non-payment, fraudulent activity, or abuse of the Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.

17. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Oregon. Each party shall bear its own costs. Small claims court actions are exempt from this arbitration requirement.

Class Action Waiver: You agree that any dispute resolution will be conducted on an individual basis and not in a class, consolidated, or representative action.

18. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Disclosed Capitol LLC regarding the use of the Service.

21. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes via email at least 30 days before the changes take effect. The updated "Last updated" date will be posted at the top of this page. Continued use of the Service after changes constitutes acceptance.
